All trademarks, service marks, trade names, logos, wordmarks, slogans, product names, and brand elements associated with Viaje, Viaje Holidays, and Viaje Holidays Private Limited are the exclusive property of Viaje Holidays Private Limited (CIN: U79110UP2026PTC243597), registered at 261, Kartora, Akbarpur, Ambedkar Nagar, Uttar Pradesh 224146, India.

These marks are protected under the Trade Marks Act, 1999 (India), the Copyright Act, 1957 (India), the Information Technology Act, 2000, and applicable international intellectual property treaties including the Paris Convention for the Protection of Industrial Property, the Madrid Protocol, and the TRIPS Agreement.

2. Class 39 Trademark — Travel Services

Viaje Holidays Private Limited claims trademark rights in the mark VIAJE under Nice Classification Class 39 — Transport and Travel Services, covering the following services:

4. Copyright

All content on the Viaje platform — including but not limited to text, graphics, user interface elements, illustrations, photographs, audio, video, AI-generated itineraries, code, database structures, and the overall design and layout of the Viaje app and website — is protected by copyright and is the exclusive property of Viaje Holidays Private Limited unless expressly indicated otherwise.

User-Generated Content

Content posted by users (travel photos, reviews, blog posts, videos) remains the intellectual property of the respective user. By posting content on Viaje, users grant Viaje a non-exclusive, worldwide, royalty-free licence to display, distribute, and promote their content on and in connection with the Platform, subject to the terms set out in Viaje's User Agreement.

5. Software, AI Models & Technical IP

The following technical intellectual property is proprietary to Viaje Holidays Private Limited and protected under the Copyright Act, 1957 (as literary works — software), the IT Act, 2000, and applicable international law:

• Viaje Platform Software — all source code, object code, algorithms, and database schemas underlying the Viaje app and web platform
• Viaje AI Itinerary Planner — the proprietary AI model, training data compilations, model weights, prompting architectures, and inference systems built by Viaje
• Hawkeye — the proprietary AI-powered safety, fraud detection, and security monitoring system
• Viaje Localisation System — the internal 14-language content localisation database and translation assets
• Viaje Verified Badge System — the visual design, verification criteria, and issuance logic for Silver, Gold, and Platinum partner and guide badges

6. Permitted Use

The following uses of Viaje's intellectual property are permitted without prior written consent:

• Editorial/journalistic use: Journalists, bloggers, and media organisations may use Viaje's name, wordmark, and unaltered logo in factual editorial coverage to accurately identify and refer to the company and its products.
• Personal non-commercial reference: Users may reference Viaje's platform name and logo in personal, non-commercial reviews, social media posts, and recommendations.
• Academic research: Researchers may refer to Viaje's name, products, and public documentation for academic study, provided the source is accurately attributed.
• Linking: Any website or individual may link to viaje.in without prior permission, provided the link does not misrepresent Viaje's products or imply an endorsement that does not exist.

7. Prohibited Use

The following uses are strictly prohibited without Viaje's prior written authorisation:

• Using "Viaje", "Viaje Holidays", or any confusingly similar name as a business name, trading name, domain name, social media handle, or product name
• Altering, distorting, recolouring, or modifying Viaje's logos, wordmark, or brand assets in any way
• Using Viaje's trademarks in a manner that implies endorsement, sponsorship, official partnership, or affiliation with Viaje where none exists
• Reproducing, republishing, or distributing Viaje's software, AI models, copyrighted content, or database contents without a licence
• Using Viaje's name or brand in advertising, promotional materials, or commercial purposes without a written licence agreement
• Filing trademark applications for marks identical or confusingly similar to Viaje's marks in any class or jurisdiction
• Creating derivative works from Viaje's copyrighted materials without express written permission
• Metatag stuffing, domain squatting, or keyword advertising using Viaje's trademarks without prior written approval

8. Licensing

Viaje may grant licences for the use of its trademarks, brand assets, or copyrighted content for specific commercial, promotional, or partnership purposes. All licences must be in writing and signed by an authorised representative of Viaje Holidays Private Limited.

To enquire about a trademark or brand licence, contact: legal@viaje.in with subject line "Trademark Licence Enquiry — [Your Organisation Name]". Include: the specific marks you wish to use, the proposed use case, the territory, and the duration.

9. Reporting Infringement

If you believe any third party is infringing Viaje's intellectual property rights, please report it to:

Please include: the infringing party's details (name, website, address), a description of the infringement, the Viaje IP being infringed, and any evidence you have. We investigate all credible infringement reports and take prompt legal action where warranted.

If you believe content on the Viaje platform infringes your own intellectual property, please submit a notice under Section 52A of the Copyright Act, 1957 or an equivalent DMCA notice. Email details to legal@viaje.in. We respond to valid takedown notices within 72 hours.

10. International Rights

Viaje asserts trademark rights in the mark VIAJE and related marks in all countries where Viaje provides services, including India, the United Arab Emirates, the United Kingdom, Japan, South Korea, France, Germany, the United States, Australia, Canada, and Singapore, under applicable national trademark law and international treaties.

International trademark applications are being filed and/or planned under the Madrid Protocol (WIPO) and through national IP offices in key markets. The filing of an Indian trademark application creates a priority claim under the Paris Convention for applications filed within 6 months in Paris Convention countries.

Viaje actively monitors trademark registers globally for conflicting marks and will take appropriate action to protect its rights in all territories.
